Terminology

  • GTCS : these general conditions of sale online on the site meyrowitz.com
  • Client : natural person placing the order for themselves or their bearer, aged over 18
  • Order : all products selected by the Customer for purchase
  • Carrier : natural person ultimately intended to carry the ordered equipment
  • Cart : virtual order for selected items, before validation
  • Company : designates the company publishing the site and seller, EB MEYROWITZ.

The purpose of these General Terms and Conditions is to inform the Customer about the procedures for placing an Order online, the delivery of the Order and the conditions for returning and refunding the products ordered.

Generalities

These General Terms and Conditions are applicable without restriction or reservation to all items offered for sale on the site, reserved for customers, non-commercial adults, who have full legal capacity.

Any order for one or more items on the site implies consultation and unreserved acceptance on the part of the Customer of these General Terms and Conditions and the applicable prices. These General Terms and Conditions take precedence over any other document.

The General Terms and Conditions may be subject to updates or modifications without notice in order to adapt to the needs of Customers, the operation of the site and changes to the regulations in force. The applicable General Terms and Conditions will then be those in force at the time of conclusion of the contract, that is to say on the day of placing the order and concomitant payment of the price.

Optical product information

The Customer is informed that the meyrowitz.com site sells spectacle frames, without corrective lenses. Eyeglass frames can accommodate corrective lenses. However, due to lack of perfect centering measurements, EB MEYROWITZ does not wish to produce corrective lenses remotely.

The Customer is informed that he can meet an optician physically in the EB MEYROWITZ store, and that he can at any time contact an EB MEYROWITZ optician for any necessary information prior to placing his order.

SUN FRAMES

The Customer is informed that European Directive EN89/696 determines the precise criteria to be respected to preserve the eye health and safety of users.

This regulation precisely defines the minimum level of protection that solar lenses must provide.

Customer declaration

  • the Customer acknowledges being aged 18 or over,
  • the Customer acknowledges that he is the holder or duly authorized to use the bank card for the payment of his Order and that his bank account is sufficiently funded to satisfy the payment.

Terms of placing the order

The Customer has the possibility of making purchases on the website http://www.meyrowitz.com and thus place your order for eyeglass frames remotely, within the strict framework of the regulatory provisions in force.

The final validation of the Order is carried out in several stages: 

  • The Customer chooses his glasses;
  • The Customer adds the selected products to the Basket;
  • If the Customer has an account then he can continue his order from his Basket;
  • After checking the elements of the Basket, the Customer validates their Basket;
  • The Customer chooses or validates the billing information;
  • The delivery methods are displayed and the Customer is invited to choose between
    • Pick up in store
    • Home delivery. Delivery costs are specified if applicable, before the end of validation of the order
  • The Customer is informed of the secure online payment methods;
  • The Customer is then invited to check the elements of the Order and to read the General Terms and Conditions before accepting them by checking the box to this effect;
  • The Customer is then redirected to the online payment module in order to pay for their Order. 
  • The Order will only be final upon payment of the price. This step constitutes the final validation of the Customer's Order at meyrowitz.com.

Prices and payment terms

Prices are indicated in euros, all taxes included, the price invoiced being that indicated in the Order.

In the event of a change in the applicable VAT rate, the sales price will be automatically adjusted upwards or downwards without further notice than the due date of the new rate.

Credit card payments are made using secure transactions provided by the service provider: STRIPE. In the context of bank card payments, the publisher of this site does not have access to any data relating to the customer's means of payment. Payment is made directly into the hands of the banking establishment.

The Customer is informed by e-mail, once the Order has been shipped, that their invoice, including delivery costs and applicable VAT, is accessible online on the meyrowitz.com website.

Product conformity - Service quality

The information mentioned on each product description sheet is that communicated by the suppliers from whom the Company has purchased its supplies.

The photographs of the products presented were taken from the products available and describe the product actually sold.

In the event of non-conformity of the product delivered to the Customer, or a defect linked to transport, the Customer may return the product by following the procedure provided below in article

RETURN – NON-CONFORMITY.

The products sold on the site strictly comply with the regulations in force, in particular the applicable French or European standards. The suppliers who provided the product conformity certificates are held by the Company.

Product unavailability

In the event of total or partial unavailability of the products after placing the Order, the Customer will be informed by email of the cancellation of their Order.

In application of the provisions of article L.121-20-3 of the Consumer Code, if the Order is canceled due to unavailability of the product, the Customer will be reimbursed the entire price of their Order within fourteen ( 14) days following the cancellation of this Order.

Delivery

Place of delivery.

Location determined by the Customer at the time of ordering.

Orders will be shipped to the address indicated by the customer, before the end of the order, and cannot be modified once the order has been validated.

If the delivery address provided by the Customer is not valid and therefore includes a return of the package for non-receipt at the address indicated, the costs of reshipping the package to the new address transmitted will be the responsibility of the Customer.

Pick up in store:

Orders to be collected in store will be made during opening hours, information for which can be consulted on www.meyrowitz.com

For all products, shipments and deliveries are announced by email to the Customer, to the email address provided by the latter in their personal space.

Delivery

Orders shipped are delivered by Colissimo, delivered against signature, within 15 working days in Metropolitan France from the seller having fully received the price corresponding to the consideration.

In the event of a delivery delay of more than 7 working days compared to the maximum period of 30 days, the Customer may contact the customer service of the meyrowitz.com site to request the cancellation of their Order, unless this delay is not the act of the Company but the result of a case of force majeure within the meaning of French case law.

In the event that the Order is definitively canceled, the Customer will obtain a refund of the price paid for their Order within 14 days following the cancellation confirmed by e-mail.

Delivery completed

Each delivery is deemed to have been made as soon as the package is made available to the Customer, in particular by the carrier, materialized by the control system used by the carrier, such as the delivery tracking system offered by La Poste concerning shipment by Colissimo.

Right of withdrawal - Return

Right of withdrawal

In accordance with current legislation, the customer has 14 days from the date of receipt of the package to request an exchange or refund. In order to exercise this right, it is up to him to return (at his own expense) the package to the address of the company's head office: EB Meyrowitz Opticiens, 5 rue de Castiglione 75001 Paris, accompanied by a letter requesting either the refund or exchange. Please note that shipping costs paid when ordering will not be refunded.

In accordance with the provisions of article L121-20-2 of the Consumer Code, the customer may under no circumstances claim to exercise any right of withdrawal for orders for all clearly personalized products.

Any return must be made completely (packaging, instructions, accessories, copy of the invoice), and the returned products must not be soiled or damaged (due to their use).

Data security

The meyrowitz.com site is subject to a data security system and has implemented the highest level of security, both for data and for financial transactions.

Responsibilities

The products comply with the regulations and standards in force in France. The Company cannot be held responsible in the event of non-compliance with the legislation of the country where the product is used. Likewise, the Company cannot be held liable in the event of indirect damage resulting from the purchase of the products.

Force majeure

Delays or non-execution of Orders resulting from a case of force majeure, as defined by law, will not give rise to compensation, and will release each party from the obligations imposed on them.

Personal data

The Company does not sell or rent this personal data to third parties.

In accordance with the regulations on personal data, the customer has a right of access, rectification, limitation of processing, portability or deletion of his personal data and can exercise these rights for information concerning him by directly addressing customer service at the email address meyrowitz@meyrowitz.com and indicating the subject of their request as well as their last name, first name, email and postal addresses accompanied by a copy of a document identity signed.

Intellectual property rights

This site is the property of the company EB MEYROWITZ which has entrusted its operation to DATALINX.

The site user has a private and non-exclusive right of use.

The reproduction of all or part of this site on any electronic medium is strictly prohibited without the express authorization of the Publication Director.

The reproduction of all or part of the content of the site on paper is authorized, subject to compliance with the following three conditions.

  • Respect for the integrity of the documents reproduced – no modification or alteration of any kind

The databases appearing on the website are protected by the Intellectual Property Code (CPI) relating to the legal protection of databases. No interpretation can be made in favor of a license of use or any right to use the mark(s) displayed on the website.

Absence of tacit validation/Partial non-validity

The fact that the Company has not required the application of any clause of these General Conditions of Sale cannot under any circumstances be considered as a tacit waiver by the Company of its rights arising from said clause.

In the event that one of the clauses of these General Conditions of Sale is declared void, deemed unwritten or invalid by current or future regulations, this clause would be deemed separable from the other clauses and would not affect their validity.

Jurisdiction/Applicable law

These General Conditions of Sale are subject to French law and any dispute will fall under the exclusive jurisdiction of the French courts of the applicant, in the absence of an amicable agreement between the parties.

Legal guarantees

The legal guarantees apply independently of any commercial guarantee granted.

 

Guarantee of conformity

Reproduction of articles L 217-4, L 217-5 and L 217-12 of the Consumer Code

Article L. 217-4: “The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility.

Article L. 217-5: “The property complies with the contract:

 

  1. If it is suitable for the use usually expected of similar goods and, where applicable:
  • if it matches the description given by the seller
  • if it presents the qualities that a buyer can legitimately expect having regard to the public declarations made by the seller, by the producer or his representative, in particular in advertising or labeling
  1. Or if it presents the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.

Article L. 217-12: “The action resulting from the lack of conformity is prescribed two years from the delivery of the goods”.

Article 2232 paragraph 1 of the Civil Code: » The postponement of the starting point, the suspension or interruption of the prescription cannot have the effect of extending the period of extinctive prescription beyond 20 years from the day of the birth of law. »

When acting under the legal guarantee of conformity, the customer:

– benefits from a period of 2 years from the delivery of the goods to take action;

– can choose between repair and replacement of the good, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code;

– is exempt from providing proof of the existence of the lack of conformity of the goods during the 6 months following delivery of the goods. This period is extended to 24 months from 18/03/2016, except for second-hand goods.

 

Guarantees relating to hidden defects

Reproduction of articles 1641, 1647 paragraph 1 and 2231 paragraph 1 of the Civil Code

Article 1641: “The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduces this use so much that the buyer would not have acquired it , or would have given only a lower price, if he had known them.

Article 1648 paragraph 1: “The action resulting from redhibitory defects must be brought by the purchaser, “within two years from the discovery of the defect”.

Article 2232 paragraph 1 of the Civil Code: “The postponement of the starting point, the suspension or interruption of the prescription cannot have the effect of extending the period of extinctive prescription beyond 20 years from the day of the birth of law. »

The customer can decide to implement the guarantee against hidden defects in the item sold within the meaning of article 1641 of the Civil Code. In this case, he can choose between canceling the sale and reducing the sale price in accordance with article 1644 of the Civil Code.
